Terms and Waiver Agreement

This Terms and Waiver Agreement is related to any services purchased from Brave Birth Collective, LLC (d/b/a “Enriched Birth®”), a legally registered business in the Commonwealth of Virginia.

We offer full refunds (minus transaction fees & shipping costs, if any) to families who experience a loss at any point prior to the course. 75% of the course fee will be refunded for cancellations submitted more than three weeks prior to the first course date. No refunds are available if cancelled less than three weeks before the first course date.

By purchasing and participating in any of Brave Birth Collective, LLC’s services, you acknowledge, understand, and accept that none of the personnel at Brave Birth Collective, LLC (“Brave Birth”) are medical professionals or qualified to provide medical advice of any kind. You agree not to rely on any information provided by Brave Birth personnel for medical purposes and to seek out medical advice and guidance from your own medical professionals prior to making medical decisions. All information provided by Brave Birth and its employees and representatives is intended for informational purposes only to assist you in better understanding the processes of pregnancy and birth and your rights and options during pregnancy, birth, and postpartum.

By participating in any of the activities, programs, services, or events provided by Brave Birth (the “Activities”), you acknowledge and accept all risks, including (A) the physical aspects of and demands, physical, emotional, and otherwise, of participating in the Activities, (B) your physical condition and health, and (D) the guidance or information given by instructors and staff.

You certify that: (A) you are physically prepared for participation in any physical Activities and have not been advised by a qualified medical professional against participating in any of the Activities, and (B) there are no health-related reasons or problems which preclude your participation in any of the physical Activities. You understand that Brave Birth is fundamentally relying on this certification in considering your acceptance for and participation in any physical Activities. If at any time you become unable under this certification to participate in physical Activities, you will refrain from doing so.

You agree to:  

1.      Waive, release and discharge Brave Birth from any and all liability, including but not limited to, liability arising from the negligence of Brave Birth for your disability or personal injury or the child you may be carrying in pregnancy (collectively “You” or “you”), property damage, property theft, or actions of any kind which may hereafter occur to the Participant traveling to and from the Activities.  The term, “Brave Birth,” shall include Brave Birth Collective, LLC, a Virginia limited liability company, the owners of Brave Birth, and the officers, directors, managers, members, partners (general and limited), employees, independent contractors, volunteers, representatives, and agents of Brave Birth, and the holders, sponsors and organizers of the Activities if affiliated with Brave Birth. 

2.      Will indemnify and hold Brave Birth harmless from and shall not sue Brave Birth for any and all liabilities or claims made as a result of your participation in the Activities, whether caused by negligence or otherwise.  

The Participant acknowledges that (a) this Waiver and Release will be used by and relied upon by Brave Birth and will govern your actions and responsibilities in and at the Activities; (b) will bind your heirs and legal representatives; (c) Brave Birth is not responsible for the errors, omissions, acts, or failures to act of any party or entity conducting or involved with the Activities or any aspect or portion of the Activities; (d) the Activities may involve a test of and challenge any member of the Participant Group’s physical, emotional and mental limits and carry with them the potential for illness, death, serious injury, and property loss.

This Waiver and Release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
